Spinnaker Arms

If you have purchased your unit, you’ll find owning a condominium is different from owning a house. Homeowners have a certain amount of freedom to do what they want with their houses. At Spinnaker Arms, we have guidelines for all residents to follow to help maintain the consistency, safety, and value of the building.

What are the guidelines?

The Condominium Act: The overarching rules we follow at Spinnaker Arms are established by the Nova Scotia Government under the Condominium Act and its regulations.

Bylaws: HCCC #155 also has bylaws that state how the building will be run, how the property will be maintained, and how the common elements will be used. These bylaws are written by the corporation’s directors, all of whom own units in the building, and are approved and/or changed by votes of the owners. Our bylaws have recently been amended. You can download our amended bylaws below.

Declaration: A condominium’s declaration is like its constitution. It describes the function, powers, and rights of the corporation, along with the obligations of the owners. It defines the units and common elements of the building and specifies how or if each owner can use those elements. The declaration also spells out how the board will make decisions about the repair and maintenance of the building, as well as the collection of common expense fees. What does the property manager do?

In broad terms, the property manager’s job is to oversee the day-to-day operations of the building, to advise the board on matters of legislation, and to implement the directions and policies set by the board. The property manager works closely with the directors but is not a member of the board. Matters you wish to bring to the board’s attention can be referred to the property manager. Specifically, our property manager is responsible for:

  • collecting condo and other fees, preparing monthly financial statements, paying invoices, ensuring that the annual audit is carried out and creating an annual operating budget in conjunction with the board
  • ensuring the guidelines in the Condominium Act, the bylaws, and the declaration are being followed; attending meetings of the board and acting upon its directions and policies; and bringing any concerns or issues to the attention of the board
  • supervising the superintendent, arranging for subcontractors (such as snow removal, landscaping, and fire safety), ensuring the property is properly insured, and communicating with the building’s residents about board decisions, upcoming activities, and maintenance issues.

What does the superintendent do?

We have a live-in superintendent at Spinnaker Arms who is responsible for maintaining the overall condition of the building. Working under the direction of the property manager, the superintendent cares for the common areas, manages tradespeople hired by the corporation, and ensures residents respect bylaws and other regulations. Unlike the superintendent at an apartment building, ours has no responsibility for issues in individual units. If you have concerns about excessive noise or behaviours in another unit, or about structural issues in your unit, contact the superintendent.

What does the board of directors do?

The board of directors is elected by the condo owners to represent their interests. The board has two main areas of responsibility: it maintains the common property and assets of the condominium corporation, and upholds the Condominium Act, bylaws, and declaration.
